Welcome to Evrtest ("we," "our," or "us"). We are built on the philosophy that students should invest in experience, not memory. By accessing or using our website, services, and AI platform (collectively, the "Service"), you agree to be bound by these Terms of Service. Please read them carefully.

1. Account Registration and Eligibility

To use the full features of the Service, you must create an account. You agree to provide accurate, current, and complete information. You are responsible for maintaining the confidentiality of your account credentials.

• Age Requirement: You must be at least 13 years old to use the Service. If you are under 18, you must have permission from a parent or legal guardian to make a purchase.
• Account Security: You may not share your account credentials with third parties or engage in multi-user account sharing. We reserve the right to terminate accounts that violate these terms.

2. AI Processing and Credit System

Evrtest operates on a credit-based system to provide AI-powered speech analysis and logic training.

• AI Sub-processors: We use third-party AI technologies, including OpenAI (Whisper) and Google (Gemini), to process your audio recordings and text interactions.
• Voice Data: Your voice recordings are processed in real-time to generate educational feedback. We do not permanently store your raw audio unless requested, and we do not use your voice data to train third-party AI models.
• Credits: Purchased credits are used solely for accessing AI evaluations. Credits have no cash value, are non-transferable, and cannot be exchanged for currency outside of our refund policy.

3. Subscriptions, Payments, and Billing

All payments are securely processed through our Merchant of Record, Paddle.com.

• Auto-Renewal: If you purchase a subscription plan, it will automatically renew at the end of each billing cycle unless canceled.
• Cancellation: You can cancel your subscription at any time through your user dashboard or by contacting us at [email protected]. You will retain access to your paid features until the end of the current billing period.
• Taxes: Depending on your location, Paddle may automatically calculate and add applicable taxes (such as VAT or Sales Tax) to your total at checkout.

4. Refund Policy

At Evrtest, we believe in a fair "Pay for what you use" system. Because our AI analysis incurs immediate hardware and API costs, our refund policy is designed to protect both the user and the platform:

• Pro-Rated Refunds: If you are unsatisfied with the Service, you may request a cancellation and refund within the first 7 days of your initial purchase.
• Usage Deduction: All refunds are subject to a deduction based on the AI credits consumed. For example, if you purchased 100 credits and used 15 before requesting a refund, you will be refunded the remaining 85% of your payment, minus any non-refundable payment processing fees.
• Full Delivery: Transactions where more than 50% of the credits have been consumed are considered a full delivery of service and are not eligible for a refund.
• Abuse Prevention: We reserve the right to deny refunds to users who demonstrate a pattern of abuse, such as creating multiple accounts to exploit the pro-rated refund system or initiating unwarranted bank chargebacks.
• How to Request: To initiate a refund, visit the Profile page on your dashboard and press the "Request a refund" button, or email [email protected]. Once approved, funds will be returned to your original payment method via Paddle.

5. Intellectual Property

All original content on the Evrtest platform, including our proprietary test questions, reading modules, logic explanations, software code, and interface design, is the intellectual property of Evrtest and is protected by copyright laws. You may not copy, reproduce, distribute, or create derivative works from our educational materials without express written permission.

6. Educational Disclaimer and AI Limitations

Evrtest is an educational preparation tool. While we strive for accuracy, artificial intelligence can occasionally produce errors or misinterpret audio inputs.

• No Guarantee of Scores: We do not guarantee that using Evrtest will result in a specific score on the IELTS, SAT, or any other standardized test.
• "As Is" Service: The Service is provided on an "as is" and "as available" basis without any warranties of any kind.

7. Acceptable Use and Restrictions

You agree not to use the Service to:

• Violate any local, state, national, or international law.
• Reverse engineer, scrape, or extract data from the Service using automated scripts or bots.
• Abuse the free demo or voice recording features by spamming the server or bypassing rate limits.
• Attempt to access administrative areas of the platform without authorization.

8. Limitation of Liability

To the maximum extent permitted by law, Evrtest and its operators shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, resulting from your use or inability to use the Service.

9. Changes to Terms

We reserve the right to modify or replace these Terms at any time. We will notify you of any material changes by posting the new Terms on this site and updating the "Last Updated" date. Continued use of the Service after any changes constitutes your acceptance of the new Terms.
